These Terms of Service ("Terms") govern your use of herlow.com (the "Site") and any purchase you make from it. The Site is operated by ECOM EAGLES LTD, trading as Herlow ("Herlow", "we", "us", "our").

By browsing the Site or placing an order, you agree to these Terms. If you don't agree with them, please don't use the Site.

1. Who we are

Herlow is a trading name of ECOM EAGLES LTD, a company registered in England and Wales under company number 14142895, with its registered office at 128 City Road, London, EC1V 2NX, United Kingdom.

We sell kitchen and dining products - dinnerware, cutlery, serving platters, barware, drinkware, and related pieces - to customers in the United States.

2. Eligibility

You must be at least 18 years old, or the age of majority in your state, to place an order. By ordering, you confirm you meet that requirement and that any information you give us is accurate and complete.

We currently sell and ship only to addresses within the United States.

3. Products, descriptions, and availability

  • We work hard to describe our products accurately, but we don't warrant that every description, image, color, dimension, or other detail is entirely error-free.
  • Ceramics, stoneware, and glassware are subject to natural variation. Slight differences in glaze, tone, grain, and finish between pieces are characteristic of the materials, not defects.
  • Colors may appear differently depending on your screen.
  • All products are subject to availability. We may change, limit, or discontinue any product at any time.
  • Our products are intended for ordinary domestic kitchen and dining use. Please follow any care instructions supplied - including guidance on dishwasher, microwave, oven, and freezer suitability. Damage caused by use outside those instructions isn't covered.

4. Pricing and payment

  • All prices are shown in US dollars (USD) and are exclusive of any applicable taxes unless stated otherwise.
  • Shipping is free on all US orders.
  • We reserve the right to correct pricing errors, even after an order has been submitted. If a product's correct price is higher than the price shown, we'll contact you before processing and give you the choice to confirm at the correct price or cancel for a full refund.
  • Payment is taken at checkout via the payment methods shown on the Site. By submitting payment details, you confirm you are authorized to use the payment method.

5. Orders and acceptance

Your order is an offer to buy. Our order confirmation email acknowledges receipt — it isn't acceptance. A contract is formed only when we dispatch your order.

We may refuse or cancel any order at our discretion, including where:

  • The product is out of stock or has been mispriced.
  • We suspect fraud, abuse, or a breach of these Terms.
  • We're unable to verify the billing or delivery details you provided.

If we cancel an order you've already paid for, we'll refund you in full.

6. Shipping and fulfillment

Orders are processed within 1–3 business days and typically delivered 4–8 business days after dispatch. These are estimates, not guarantees.

Fulfillment origin: Our London address is a business contact address, not a warehouse. Orders are fulfilled and shipped through international logistics partners and warehouses, so the shipping origin of your parcel may differ from the address listed on the Site. By placing an order you acknowledge this.

Risk of loss passes to you on delivery. Full details are in our Shipping Policy, which forms part of these Terms.

7. Returns, refunds, and exchanges

You have 30 days from delivery to return eligible items. All returns must be authorized in advance - email us for a Return Authorization (RA) number before shipping anything back. Items must be unused, unwashed, and in their original packaging, and complete sets must be returned complete.

Certain items are final sale, including anything that has been used or washed, items with broken hygiene seals, and personalized or made-to-order pieces.

8. Your account

If you create an account, you're responsible for keeping your login details confidential and for all activity under your account. Tell us immediately at support@herlow.com if you suspect unauthorized use. We may suspend or terminate an account that we reasonably believe has been used in breach of these Terms.

9. Acceptable use

You agree not to:

  • Use the Site for any unlawful purpose or in breach of any applicable law.
  • Attempt to gain unauthorized access to the Site, its servers, or any connected system.
  • Introduce viruses, malware, or any other harmful code.
  • Scrape, harvest, or systematically extract data from the Site without our written permission.
  • Use the Site to transmit unsolicited advertising, harassing content, or material that infringes anyone's rights.

10. Intellectual property

All content on the Site - including text, product photography, graphics, logos, and the Herlow name - is owned by or licensed to ECOM EAGLES LTD and is protected by intellectual property laws. You may view and print content for your own personal, non-commercial use. You may not reproduce, distribute, or commercially exploit it without our written permission.

11. User-submitted content

If you submit a review, photo, comment, or other content, you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, and display it in connection with our business. You confirm the content is yours to share and doesn't infringe anyone's rights. We may remove content that is unlawful, offensive, or misleading, but we aren't obliged to monitor it.

12. Third-party links and services

The Site may link to or rely on third-party services (for example, payment processors, carriers, and analytics providers). We don't control those services and aren't responsible for their content, policies, or practices. Your dealings with them are between you and them.

13. Disclaimers

The Site and its content are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We don't warrant that the Site will be uninterrupted, secure, or error-free, or that defects will be corrected.

Nothing in these Terms limits or excludes any right you have under applicable consumer protection law that cannot lawfully be limited or excluded.

14. Limitation of liability

To the fullest extent permitted by law, ECOM EAGLES LTD, its directors, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of your use of the Site or any product purchased from it.

Where liability cannot be excluded, our total aggregate liability to you in connection with any order is limited to the amount you paid for that order.

15. Indemnity

You agree to indemnify and hold harmless ECOM EAGLES LTD and its officers, directors, employees, and agents from any claim, demand, loss, or expense (including reasonable legal fees) arising from your breach of these Terms or your misuse of the Site.

16. Force majeure

We aren't liable for any failure or delay in performance caused by events beyond our reasonable control - including carrier delays, extreme weather, natural disasters, strikes, war, epidemics, or failures of infrastructure or third-party services.

17. Changes to these Terms

We may update these Terms at any time. The version in force is the one published on this page at the time you place your order. Changes take effect when posted, and the "Last Updated" date above will tell you when that was. Please check back periodically.

18. Severability and waiver

If any provision of these Terms is found unenforceable, the remaining provisions stay in full effect. Our failure to enforce any right or provision isn't a waiver of it.

19. Governing law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales will have jurisdiction over any dispute. This does not deprive you of the protection of any mandatory consumer laws of the US state in which you reside.
